US Court Orders Freedom of Abrego Garcia from Immigration Detention

A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.

"Since his release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to face human smuggling allegations, he was detained in immigration custody.

In her decision, the judge pointed out that the authorities does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Context of the Case

The legal proceedings involve disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.

Terms of Release

The court, who was overseeing his challenge to removal in a federal court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
